All qualified full-time employees shall receive ten (10) days of sick leave allocated on January 1st each year. Should an employee become qualified after January 1st of any given year to receive sick leave, the employee shall receive a prorated allocation of sick days for the remainder of the year. All sick leave expires on December 31st of a calendar year. Any sick leave not utilized within the calendar year it is earned is void and forfeited.

An employee is entitled to use sick leave when he or she:

b. would jeopardize the health of others by his or her presence on the job because of exposure to a communicable disease or inability to properly perform his or her normal job duties.

Paid sick leave will not be granted as vacation leave, and can only be used when the employee is unable to work because of illness or injury. Employees may utilize sick leave for verified personal illness. Verified personal illness means that the illness is documented by a physician providing treatment for the illness. If an employee fails to provide documentation from a physician of the illness, any time missed will be treated as an absence according to the policies of Company.

Sick leave is only available for personal illness and does not extend to family members. In the event that an employee is required to miss work due to a family illness, the employee may utilize vacation time, to the extent the employee has vacation time available.

Any time off, paid or unpaid, may qualify as “Family Medical Leave” (FMLA) or may be declared FMLA by Company. Any questions regarding FMLA should be directed to the Human Resources Department.

In instances where an employee has suffered injury compensable by Worker’s Compensation, sick leave cannot be utilized. The employee should instead follow the requirements set forth pursuant to the Worker’s Compensation policies and laws.

No payment for sick leave shall be made during the first six (6) months of employment.
